These are the terms on which Continental Limited also trading as Webnetism (Company No. 01727463) (‘Continental’) do business.
Continental offers a one stop IT and Web solution to meet the Client’s needs to have an effective IT system and web presence on the internet. The Client may select from Continental’s website, brochure or marketing materials a range of products and services which Continental has to offer. Depending on the Client’s selection, the terms and conditions applying to the Client may vary. If the Client has any suggestions or comments or if the Client needs to contact Continental, please do so by using the contact details below or those on Continental’s website.

If you are a business, the General Terms and Conditions will apply. If the Client would like Continental to assist in procuring and renewing domain names for the Client, and/or registering the domain with search engines, the Domain Name Terms will apply. If the Client would like Continental to carry out design work including web design and/or website development work for the Client or carry out website optimisation services, the Design and Website Development Terms will apply. If the Client would like Continental to host the Client’s website, its email or provide remote backup services, the Website and E-mail Hosting and Remote Backup Terms will apply. If the Client would like Continental to supply the Client with hardware such as monitors, PCs, servers, mouse, cables, software or such other products listed on Continental’s website or catalogues, the Hardware and Software Terms will apply.
In addition to the terms and conditions above the below summarised items should be noted:
Contracts of sale All orders are subject to acceptance to Continental and to availability of goods ordered. Continental reserves the right to refuse any order.
The Customer undertakes that all details provided for the purchase of goods via our websites are correct.
The Customer also undertakes that the credit card or debit card used to purchase goods is either their own or their Company's own and that they have authorisation to use it. The Customer furthermore undertakes that sufficient funds will be available to cover the costs of goods ordered. Continental reserves the right to satisfy itself as to the validation of credit or debit cards prior to supply of goods.
Returns Policy All transactions entered into by Continental with the consumer are subject to the Consumer Protection (Distance Selling) Regulations 2000. This stipulates that the buyer has the right to cancel the contract and that such cancellations must be notified in writing to the seller within a period of 7 working days from date of receipt of goods.

Prices Goods are invoiced at the price prevailing at the time of order. Invoices will include VAT unless specifically indicated.
Continental reserves the right to modify pricing where necessary from time to time.
Delivery, Title and Risk Times and dates stated for delivery can only be estimated. Whilst every effort will be made to meet Customer requirements and deadlines, Continental cannot accept liability for failure to deliver within the stated timescales.
If for any reason and in the unlikely event that Continental is unable to deliver goods, the Customer will be offered the opportunity to cancel the order or select alternative goods available.
Continental cannot accept liability for damage or incomplete deliveries unless notified by the Customer within 7 days of delivery. The Customer is responsible for accepting delivery of goods once ready.
Delivery is deemed to have taken place once goods have been delivered to the Customer's given delivery address. At this point, all risk of loss, breakage and damage pass to the Customer.
Title to the goods passes from Continental to the Customer when payment has been received in full.
If the Customer is unable to accept delivery of the goods, Continental may a) store and insure the goods at the Customer's expense and risk, b) resell the goods at the best price obtainable and refund the customer any excess achieved once storage and restocking coats have been deducted, c) re-arrange at later date at the Customer's expense.
Payment Standard terms of payment are by debit or credit card payable at the point of order. Other terms may be agreed at the discretion of Continental and in writing.
If payment terms other than by debit or credit card prior to delivery are agreed and payment is not made on the due date, Continental will be entitled to charge interest on any outstanding balance at an interest rate of 3% above Barclays Bank plc base lending rate applicable at the time.
Continental Ltd retaind the Right of Title to all goods and services until they are paid for in full.
Warranties and Returns Although Continental is committed to providing customers with the highest possible quality of products and services, products may, on occasion, be found to be faulty or defective. In any such case the warranty for iiyama monitors is held with iiyama, they offer a three year on site UK warranty. For details of their warranty please go to their website www.iiyama.co.uk .
Subject to the right of the consumers to return goods for refund under the Consumer Protection (Distance Selling) Regulations 2000, Continental does not sell products on a trial basis. We strongly recommend that our customers check suitability and specification of products before placing orders.
In the event of Continental agreeing to accept the return for credit of unwanted products at its discretion (unless under the Consumer Protection (Distance Selling) Regulations 2000), these must be returned with Continental's written agreement within 14 days of date of delivery. The goods must be unopened and in perfect resalable condition. Goods returned in these circumstances will be subject to a restocking fee of 15% of the sales value of the goods, or £20.00, whichever is the greater.
All goods should be returned under a Continental Returns Authorisation Number, which will be issued by our customer support staff on request. No goods can be accepted for return without this number.
With regard to the return of faulty goods, it is the Customer's responsibility to ensure that the goods are adequately packed. Continental cannot accept liability for goods damaged in transit due to insufficient packaging.
Proof of postage is not proof of delivery; customers are advised that goods returned should be sent via either recorded delivery, registered post or by courier, with sufficient insurance to cover replacement value of the goods.
On receipt of the returned product, Continental will test it to verify the fault. If, following this procedure the product is found to be in good working order, we will return the product back to you.
All warranties will be rendered inapplicable if goods have been interfered with, altered or damaged in any way by the Customer, or if the goods have not been used in accordance with the manufacturer's instructions.
Unless otherwise stated in the manufacturer's documentation, all goods supplied to Customers in the UK carry a manufacturer's warranty. If any claim is made against the warranty, Customers must adhere to the manufacturer's instructions and procedures. Where possible, to resolve warranty issues as quickly as possible, the manufacturer will deal directly with the return. Where iiyama monitors are concerned, please contact iiyama on 0870 224 95 95.
ISO 13406-2 Guidelines for Pixel Defects
LCD displays are made up of a set number of pixels and each pixel is made from 3 sub-pixels; one Red, one Blue and one Green. Every sub-pixel is addressed by its own transistor and so the manufacture of a glass substrate is very complex. Due to the nature of the manufacturing process, occasional defects can occur. Pixel defects or failures cannot be fixed or repaired and can happen at any stage in the LCD's life.
To regulate the acceptability of defects and to protect the end user, ISO have created a standard for manufacturers to follow. ISO 13406-2 recommends how many defaults are acceptable in a display before it should be replaced, within the terms & conditions of warranty. All reputable manufacturers conform to and support the ISO 13406-2 standard.
The table below shows the allowable number of malfunctioning pixels that are acceptable, depending on the native resolution of the LCD and allowing for 2 malfunctioning pixels per million pixels.

The above is relevant to Class II LCD panels.
Continental's Liability Continental cannot accept any liability for consequential or indirect damage, for example loss of profit, goodwill or data or other financial loss not related to the price paid for the goods. All losses will be limited to the amount paid for the goods ordered.
Continental's liability for death or personal injury caused by negligence is not limited by this agreement.
Health and Safety Continental confirms that goods it supplies do not present a hazard to health and safety in accordance to the Health and Safety at Work Act, 1974 under condition that : The goods are properly used for the purpose for which they are designed and the Customer takes reasonable precautions in their use.
Force Majeure If Continental is prevented from meeting the terms of its contract with the customer as a result of Force Majeure, it will not be deemed to be breach of the contract with the customer.
The Consumer Protection (Distance Selling) Regulations 2000 Contracts entered into by Customers not acting in the course of a business are subject to The Consumer Protection (Distance Selling) Regulations 2000.
Should the Regulations apply, Customers may cancel goods by giving notice in writing within 7 days of the date of delivery of the goods by post, e-mail or fax to Continental.
If the Customer exercises the right to cancel under the Regulations, he or she will be responsible for the cost of returning the goods.
The customer will be liable for any damage to the goods if there is any failure to comply with this obligation.
Errors and Omissions Although Continental makes every effort to be accurate with the goods it represents on the website, it is unavoidable that errors and omissions will occur. Should this instance arise, Continental will have the right to rescind the contract, even if payment has already been received. Continental will in this event refund any monies paid by the Customer. The Customer may either cancel his or her purchase, or in the case of an incorrectly given price, pay the difference between the price given and the correct price.
General No clauses or conditions in the document affect your statutory rights as a consumer.
If there proves to be any clause or condition that is found to be invalid or enforceable, that item may be struck from the Agreement without any influence on the validity of the remainder of the Agreement. Any such waiver must be in writing and agreed by Continental.
Headings given are for ease of reference and do not affect the interpretation of the Agreement.
Correspondence regarding changes in the Agreement should be exchanged by post, fax or e-mail, although proof of delivery may be required.
All terms and conditions contained in the Agreement will be subject to the jurisdiction of the English courts. Continental reserves the right to amend the terms and conditions contained in the Agreement at any time.
